While this is referred to as a demotion in the lawsuit, it is considered a lateral transfer within the Sheriff’s Office. Bybee claims that he did not attempt to appeal the discipline because supervisors assured him that his position would not be affected. Bybee says that he dropped off the RV on May 12 for minor repairs that he expected to be completed in 10 days. Berman is known for representing Sheriff’s Office employees in suits against Knight. Bybee continued to check on his RV for several months, learning that the repairs had not been made and that water had leaked into the motor home. In the lawsuit, Bybee claims mechanics told him they were directed to issue him an older patrol vehicle with obvious damage. There is no mention in the internal affairs investigation that Bybee would be transferred from his position as detective.
